The State Council of Ministers is the executive body of a state government in India, established under Articles 163 and 164 of the Indian Constitution. It consists of the Chief Minister as the head and other ministers who collectively form the real executive authority at the state level.

This institution represents the adaptation of the Westminster parliamentary system to India's federal structure, ensuring democratic governance at the state level. The Council operates on the principle of collective responsibility, meaning all ministers are jointly accountable to the state legislature for government policies and decisions.

The Governor, though the constitutional head of the state, acts on the aid and advice of this Council in most matters, making it the de facto executive authority. The formation of the State Council of Ministers follows a specific constitutional procedure.

The Council includes ministers of different ranks: Cabinet Ministers who head important departments and participate in cabinet meetings, Ministers of State who may have independent charge of departments or assist Cabinet Ministers, and Deputy Ministers who work under Cabinet Ministers or Ministers of State.

The principle of collective responsibility is fundamental to the functioning of the State Council of Ministers. This means that all ministers must publicly support government decisions, even if they privately disagreed during discussions.

If a minister cannot support a major government policy, they are expected to resign. This principle ensures unity in government action and maintains public confidence in the administration. Individual responsibility complements collective responsibility, making each minister accountable for their specific department's performance.

The relationship between the State Council of Ministers and the Governor is crucial to understanding state governance. While the Governor is the constitutional head, they must act on the aid and advice of the Council in most matters.

However, the Governor retains certain discretionary powers, particularly in situations involving constitutional crises, such as when no party has a clear majority or during periods of political instability.

The tenure of the State Council of Ministers is not fixed but depends on maintaining the confidence of the legislative assembly.

Ministers hold office during the pleasure of the Governor, but in practice, this means they serve as long as they enjoy the support of the legislature. The Council's term effectively ends when the legislative assembly is dissolved or when it loses the confidence of the house.

This system ensures that the executive remains accountable to the elected representatives of the people, maintaining the democratic character of governance.
