Definition

The Land Boundary Agreement (LBA) 2015 between India and Bangladesh is a historic bilateral treaty that resolved decades-old border disputes between the two nations. This agreement fundamentally transformed the complex border situation that had persisted since the 1947 Partition of India.

The LBA addressed three major border issues: the exchange of enclaves (small pockets of territory belonging to one country but surrounded by another), the settlement of adverse possessions (areas occupied by one country but legally belonging to another), and the demarcation of undemarcated border segments.

The agreement was particularly significant because it required India to amend its Constitution through the 100th Constitutional Amendment Act, 2015, marking only the second time in Indian history that a constitutional amendment was made specifically to ratify an international agreement.

The LBA resolved the status of 162 enclaves - 111 Indian enclaves located within Bangladesh and 51 Bangladeshi enclaves within India. These enclaves, some as small as a few square meters, had created a complex administrative nightmare where residents lived in a legal limbo, unable to access basic services from either country.

The agreement provided these residents with the choice to either relocate to their country of origin or remain in their current location and acquire citizenship of the host country. Most chose to stay and acquire new citizenship.

The LBA also addressed adverse possessions, where approximately 2,777.038 acres were transferred from India to Bangladesh, and 2,267.682 acres from Bangladesh to India. This exchange was based on ground realities and aimed to create a more rational and manageable border.

The agreement's implementation required extensive coordination between both governments, including joint surveys, demarcation exercises, and rehabilitation programs for affected populations. The LBA represents a model of peaceful border dispute resolution through diplomatic negotiations rather than conflict, demonstrating how historical grievances can be addressed through mutual understanding and compromise.
