Definition

The National Green Tribunal (NGT) is India's specialized environmental court established in 2010 to handle cases related to environmental protection, forest conservation, and natural resource management.

Think of it as a dedicated judicial body that deals exclusively with environmental matters, making it faster and more efficient than regular courts for environmental disputes. The NGT was created because environmental cases in regular courts were taking too long, and judges often lacked the technical expertise needed to understand complex environmental issues.

The Tribunal combines legal expertise with scientific and technical knowledge through its unique composition of judicial and expert members. It operates under the National Green Tribunal Act, 2010, and draws its constitutional authority from Article 21 (Right to Life) and Article 48A (State's duty to protect environment).

The NGT has the power to hear cases related to air and water pollution, forest clearances, environmental impact assessments, waste management, and biodiversity conservation. Unlike regular courts, the NGT follows principles of sustainable development and the precautionary principle in its decisions.

It can award compensation for environmental damage and issue directions for environmental restoration. The Tribunal has five benches located in New Delhi (Principal Bench), Pune, Kolkata, Chennai, and Bhopal, making it accessible across different regions of India.

The NGT has been instrumental in addressing major environmental issues like air pollution in Delhi, river cleaning projects, illegal mining, and industrial pollution. It operates on the principle that environmental justice should be swift, affordable, and scientifically informed.

The Tribunal's decisions are binding and can only be appealed to the Supreme Court, ensuring finality in environmental disputes. Since its establishment, the NGT has disposed of thousands of cases and has become a crucial institution in India's environmental governance framework.
