42nd Amendment	1976	Passed during the 1975-77 Emergency, this amendment significantly expanded emergency powers and restricted judicial review. It replaced 'internal disturbance' with 'armed rebellion' as grounds for National Emergency, extended the duration of Lok Sabha and state assemblies during emergency, and limited the Supreme Court's jurisdiction to review emergency proclamations. It also added the words 'Socialist' and 'Secular' to the Preamble and made several other changes strengthening the executive at the expense of judiciary and legislature.	The amendment was largely seen as an attempt to constitutionalize the Emergency and prevent judicial interference. However, many of its provisions were struck down by the Supreme Court in Minerva Mills case (1980) and later amended by the 44th Amendment. It demonstrated the dangers of constitutional amendments during emergency periods and led to the development of the basic structure doctrine as a check on unlimited amendment power.
44th Amendment	1978	This amendment was passed by the Janata government to undo the excesses of the Emergency period and the 42nd Amendment. It restored the balance between different organs of government, made the advice to declare emergency justiciable, changed 'internal disturbance' back to 'armed rebellion' with higher threshold, and ensured that Articles 20 and 21 cannot be suspended even during emergency. It also restored the original tenure of Lok Sabha and state assemblies.	The 44th Amendment significantly strengthened safeguards against misuse of emergency provisions while maintaining their availability for genuine crises. It restored judicial review of emergency proclamations, introduced the requirement of written advice, and protected core fundamental rights even during emergencies. This amendment represents the constitutional learning from the Emergency experience and continues to shape emergency jurisprudence in India.
